1. Definitions

• "Platform": The website/app operated by Book by Skill.
• "Digital Worker": A registered user offering services (developers, designers, testers, etc.).
• "Company/Client": A registered user booking digital workers.
• "We/Us": Book by Skill, the platform operator.

2. Eligibility

• You must be at least 18 years old to use this platform.
• You must provide accurate information when creating your account.
• We may suspend or terminate accounts that violate these terms.

3. Services We Provide

• A marketplace for companies to find and book digital workers by skill and availability.
• Scheduling and calendar management for digital workers.
• Communication tools between workers and clients.

Important: We are not an employer. Digital workers are independent, and companies are responsible for their own agreements with them.

4. User Responsibilities

Digital Workers:

• Keep your availability and profile information up to date.
• Deliver services professionally and honestly.
• Respect client confidentiality.

Companies:

• Book workers fairly and pay for agreed services.
• Provide clear project requirements.
• Respect worker time and availability.

5. Booking & Payments

• At launch, payments may be handled directly between company and worker.
• Disputes over payments must be resolved between company and worker, unless otherwise stated.

6. Prohibited Conduct

You agree not to:

• Use the platform for illegal or fraudulent activities.
• Misrepresent your skills, availability, or identity.
• Harass, abuse, or discriminate against other users.
• Circumvent the platform's booking or payment system.

7. Intellectual Property

• You keep ownership of your content (profiles, portfolios, tasks).
• By posting on the platform, you grant us a limited license to display your content for the purpose of operating the platform.
• Our trademarks, branding, and software remain our property.

8. Limitation of Liability

We provide the platform "as is" without warranties. We are not responsible for:

• The quality of services delivered by digital workers.
• The accuracy of profiles.
• Any direct or indirect damages arising from using the platform.

9. Termination

We may suspend or terminate accounts that violate these terms. You may close your account anytime.

10. Governing Law

These terms are governed by the laws of Germany.
